Acceptable Use Policy

This Acceptable Use Policy applies to all services provided by Dirac Cloud, operated by Regulator Trading (Pty) Ltd (“Dirac Cloud”, “we”, “us” or “our”).

By using our services, you agree to comply with this policy. This policy forms part of our Terms and Conditions.

Lawful Use

You may only use Dirac Cloud services for lawful purposes.

You may not use our services to create, host, store, distribute or facilitate content or activities that violate applicable laws or regulations.

This includes activities involving fraud, theft, unlawful access to computer systems, malicious communications, intellectual property infringement or other unlawful conduct.

Network and Security Abuse

You may not use our services to interfere with, compromise or attempt to gain unauthorised access to networks, systems, services or data.

Prohibited activities include:

  • unauthorised vulnerability scanning or penetration testing;

  • brute-force attacks or credential attacks;

  • exploitation of security vulnerabilities;

  • distribution or operation of malware, ransomware, botnets or similar malicious software;

  • denial-of-service or distributed denial-of-service attacks;

  • interception or manipulation of network traffic without authorisation;

  • IP address spoofing or other attempts to conceal the source of abusive traffic; and

  • operating systems or services for the purpose of attacking or compromising third parties.

Legitimate security research, vulnerability testing and penetration testing are permitted where you have appropriate authorisation and the activity does not negatively affect our infrastructure or other customers.

Spam and Messaging Abuse

Our services may not be used to send, distribute or facilitate unsolicited bulk electronic communications or spam.

This includes email, messaging, advertising and other forms of electronic communication.

You must not operate open mail relays, compromised mail servers or other systems that facilitate spam.

We may restrict email functionality or network access where we reasonably believe a server is being used for spam or has become compromised.

Malicious and Deceptive Content

You may not use our services to host or distribute:

  • phishing websites or fraudulent login pages;

  • malware or malicious software;

  • content designed to steal passwords, financial information or other sensitive information;

  • fraudulent schemes or impersonation intended to deceive others; or

  • infrastructure used to command, control or support malicious systems.

Intellectual Property

You must respect the intellectual property rights of others.

Our services may not knowingly be used to distribute or host content that infringes copyright, trademarks or other intellectual property rights.

We may remove or restrict access to content where required by law or where we receive a valid legal notice concerning the content.

Resource and Infrastructure Abuse

VPS resources must be used in a manner that does not materially interfere with the stability, security or performance of the Dirac Cloud platform or other customers.

You may not deliberately:

  • overload or disrupt our infrastructure;

  • circumvent technical resource limits;

  • interfere with other virtual servers or customers;

  • attempt to access the underlying hypervisor, host systems or management infrastructure;

  • manipulate resource accounting or monitoring systems; or

  • use excessive network, CPU, storage or other resources in a manner that materially degrades services for other customers.

High-resource workloads are permitted provided they remain within the limits of the service purchased and do not adversely affect the platform or other customers.

Proxies, VPNs and Similar Services

Proxies, VPNs, Tor nodes and similar network services may be operated provided they comply with this policy.

You remain responsible for activity originating from your VPS and must take reasonable steps to prevent your service from being used for abuse.

We may suspend or restrict services that generate significant abuse complaints or pose a security or network risk.

Customer Security Responsibilities

You are responsible for securing and maintaining your VPS.

This includes maintaining appropriate passwords and authentication controls, applying security updates where appropriate and taking reasonable precautions against unauthorised access.

If a VPS becomes compromised and is being used for abusive or malicious activity, we may temporarily restrict or suspend the service to protect our network and third parties.

IP Addresses and Network Reputation

IP addresses provided by Dirac Cloud may not be used for abusive activities that negatively affect the reputation of our network or IP address space.

Where an IP address becomes listed on a recognised blocklist as a result of customer activity, we may require the customer to resolve the underlying issue before network access is restored.

Customers may not deliberately manipulate routing, source addresses or network configurations in a way that interferes with Dirac Cloud infrastructure or third-party networks.

Abuse Complaints

We may investigate complaints concerning activity originating from our network.

Customers are expected to cooperate with reasonable abuse investigations and take corrective action where necessary.

Abuse reports relating to Dirac Cloud services may be sent to support@dirac.co.za.

Monitoring and Investigation

Dirac Cloud does not routinely monitor the content stored on customer VPS servers.

However, we may investigate network activity, system information, abuse reports or other relevant information where reasonably necessary to:

  • protect our infrastructure and customers;

  • investigate suspected violations of this policy;

  • respond to security incidents;

  • comply with applicable law or valid legal processes; or

  • prevent or mitigate abuse.

Suspension and Termination

We may restrict, suspend or terminate a service that violates this policy.

Where reasonably practical, we may contact the customer and provide an opportunity to resolve the issue before suspension.

We may take immediate action without prior notice where activity presents an urgent security risk, causes network disruption, involves serious abuse or unlawful activity, or could cause significant harm to Dirac Cloud, our customers or third parties.

Repeated or serious violations may result in permanent termination of services.

Law Enforcement and Legal Requests

Dirac Cloud will comply with applicable South African law and valid legal processes.

We may preserve or disclose information where required by law, court order or another legally binding request.

Nothing in this policy requires Dirac Cloud to permit activity that we reasonably believe exposes our infrastructure, customers or third parties to significant security, operational or legal risk.

Changes to this Policy

We may update this Acceptable Use Policy from time to time to reflect changes to our services, security requirements, industry practices or legal obligations.

The latest version will be published on the Dirac Cloud website.
